    Article 1 - Definitions

    The following terms are understood in these conditions:

    • Additional agreement: an agreement in which the consumer acquires products, digital content and/or services in connection with a distance contract and these goods, digital content and/or services are delivered by chesterfieldbond.com or by a third party, based on an agreement between that third party and chesterfieldbond.com;
    • Consumer: the natural person who does not act for purposes related to his trade, business, craft or professional activity;
    • Day: calendar day;
    • Digital content: data produced and delivered in digital form;
    • Duration contract: a contract for the regular delivery of goods, services and/or digital content for a certain period;
    • Durable data carrier: any tool - including email - that enables the consumer or chesterfieldbond.com to store information that is personally addressed to him in a way that allows future consultation or use for a period that is tailored to the purpose for which the information is intended, and allows unaltered reproduction of the stored information;
    • Right of withdrawal: the consumer's legal option to cancel the distance contract within the cooling-off period;
    • chesterfieldbond.com: the legal entity that offers (access to) digital content and/or services to consumers at a distance;
    • Distance contract: a contract concluded between chesterfieldbond.com and the consumer as part of an organized system for distance selling of products, digital content and/or services, using one or more techniques for distance communication until the conclusion of the contract;
    • Technique for distance communication: means that can be used to conclude a contract, without the consumer and chesterfieldbond.com having to be in the same room at the same time.

    Article 3 - Applicability

    These general terms and conditions apply to every offer from chesterfieldbond.com and to every distance contract concluded between chesterfieldbond.com and the consumer.

    Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, chesterfieldbond.com will indicate before the distance contract is concluded, how the general terms and conditions can be viewed at chesterfieldbond.com and they will be sent free of charge as soon as possible at the consumer's request.

    If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically in such a way that they can be easily stored on a durable medium. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be electronically inspected and that they will be sent free of charge at the consumer's request, electronically or otherwise.

    In the event that in addition to these general terms and conditions, specific product or service conditions also apply, the second and third paragraphs apply mutatis mutandis and in the event of conflicting terms and conditions, the consumer can always rely on the applicable provision that is most favorable to him.

    Article 4 - The offer

    If an offer has a limited duration or is subject to conditions, this is explicitly stated in the offer.

    The offer contains a full and accurate description of the offered products, digital content and/or services. The description is sufficiently detailed to allow a good assessment of the offer by the consumer. If chesterfieldbond.com uses images, these are a true representation of the offered products, services and/or digital content. Obvious mistakes or errors in the offer do not bind chesterfieldbond.com.

    Each offer contains such information that it is clear to the consumer what the rights and obligations are that are connected to the acceptance of the offer.

    Article 5 - The agreement

    The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and the fulfillment of the conditions set.

    If the consumer has accepted the offer electronically, chesterfieldbond.com immediately confirms receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by chesterfieldbond.com, the consumer can dissolve the agreement.

    If the agreement is concluded electronically, chesterfieldbond.com will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a safe web environment. If the consumer can pay electronically, chesterfieldbond.com will observe appropriate security measures.

    chesterfieldbond.com can - within legal limits - inform itself whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If chesterfieldbond.com has good reasons not to enter into the agreement on the basis of this investigation, he is entitled to refuse an order or request or to attach special conditions to the execution.

    chesterfieldbond.com will send the following information with the product, service or digital content, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium.

    Article 6 - Compliance agreement

    chesterfieldbond.com guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.

    Article 7 - Delivery and execution

    chesterfieldbond.com will take the greatest possible care when receiving and executing orders for products and when assessing applications for the provision of services.

    The place of delivery is the address that the consumer has made known to chesterfieldbond.com.

    With due observance of what is stated in article 4 of these general terms and conditions, chesterfieldbond.com will execute accepted orders with due speed but at the latest within 10 days. If the delivery is delayed, or if an order cannot or only partially be executed, the consumer will receive notification of this no later than 10 days after he has placed the order. In that case, the consumer has the right to dissolve the agreement without costs and the right to possible compensation.

    After dissolution in accordance with the previous paragraph, chesterfieldbond.com will immediately repay the amount that the consumer has paid.

    Article 8 - Duration

    The duration of the agreement is the duration as stated in the agreement. This cannot be changed unless fairness and reasonableness oppose a change before the end of the agreed duration.

    Article 9 - Payment

    Unless otherwise stipulated in the agreement or additional conditions, the amounts owed by the consumer must be paid after the conclusion of the agreement. In the case of an agreement to provide a service, this period commences on the day after the consumer has received the confirmation of the agreement.

    The consumer has the duty to report inaccuracies in provided or stated payment details immediately to chesterfieldbond.com.

    Article 10 - Complaints procedure

    chesterfieldbond.com has a well-publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

    Complaints about the execution of the agreement must be submitted fully and clearly described to chesterfieldbond.com within a reasonable time after the consumer has discovered the defects.

    Complaints submitted to chesterfieldbond.com will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, chesterfieldbond.com will respond within the period of 14 days with a message of receipt and an indication when the consumer can expect a more detailed answer.

    The consumer must give chesterfieldbond.com at least 4 weeks to resolve the complaint in mutual consultation. After this period, a dispute arises that is subject to the dispute settlement.

    Article 11 - Disputes

    Dutch law applies exclusively to agreements between chesterfieldbond.com and the consumer to which these general terms and conditions apply.

    Disputes between the consumer and chesterfieldbond.com about the conclusion or execution of agreements with regard to products and services to be delivered or delivered by chesterfieldbond.com can, with due observance of the provisions below, be submitted to the SGC or Kifid affiliated disputes committee by both the consumer and chesterfieldbond.com.

    A dispute is only dealt with by the Disputes Committee if the consumer has first submitted his complaint to chesterfieldbond.com in good time.

    If the complaint does not lead to a solution, the dispute must be brought before the Disputes Committee in writing or in another form to be determined by the Committee within 12 months after the date on which the consumer submitted the complaint to chesterfieldbond.com.

    When the consumer wants to submit a dispute to a Disputes Committee, chesterfieldbond.com is bound by this choice. Preferably, the consumer will first report this to chesterfieldbond.com

    The decisions of the Disputes Committee are made by way of binding advice.

    The Disputes Committee will not handle a dispute or will stop the handling if chesterfieldbond.com has been granted a suspension of payments, has become bankrupt or has actually ended its business activities before a dispute has been handled by the committee at the hearing and a final decision has been made.

    Article 12 - Additional or deviating provisions

    Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.

    Changes to these conditions are only effective after they have been published in an appropriate manner, on the understanding that in the event of applicable changes during the term of an offer, the provision that is most favorable to the consumer will prevail.
